Air Quality Control Commission Rulemaking Guidebook Draft, 

Public Comment Period: February 26, 2025 - March 28, 2025

The Air Quality Control Commission has published a revised draft Rulemaking Guidebook and associated materials for public review and feedback. The draft guidebook was updated to reflect the Commission’s new Procedural Rules.

The purpose of the guidebook is to help the public and stakeholders:

  • Understand how air quality regulations are developed and adopted in Colorado.
  • Provide an overview of the commission’s rulemaking process.

The guidebook explains procedures and offers guidance for those who want to participate in the process.

Feedback from this comment period will inform the final guidebook. The updated guidebook is intended to provide clear,  accessible information to help the public understand and engage in the rulemaking process. The draft guidebook is available for public comment until March 28, 2025. Submit any comments to​ ​cdphe.aqcc@state.co.us using the subject line “Rulemaking Guidebook​".

 

Public participation and hearing guidance
The Guidebooks have been prepared to provide members of the public and other interested parties information on the hearing processes, known as “rulemaking”, "adjudication", and "informational or public". Following are our guidance documents. Templates referenced are available upon request through the commission office.

Public Participation Workshop. The workshop provides members of the public with information on how to most effectively participate in commission rulemaking proceedings. The video and presentation linked below were provided in the context of a specific hearing, but the general principles apply for all rulemaking hearings.

If you wish to participate in the commission’s hearing processes, you are responsible for reviewing relevant statutes and rules that apply to the hearing process to make sure you understand your rights and responsibilities. More details about these processes may be found in the Commission’s Procedural Rules, 5 CCR 1001-1, the Air Pollution Prevention and Control Act (APPCA), C.R.S. §25-7-101, et seq., and the Colorado Administrative Procedures Act (APA), C.R.S. §24-4-103.
