Proposed regulation changes to 6 CCR 1007-2 Part 1.7.4.
The Remediation Program is proposing changes to Section 1.7.4 of the Regulations Pertaining to Solid Waste Sites and Facilities, 6 CCR 1007-2 Part 1. The proposed changes requests an increase to the hazardous substance response fund from $0.05 to $0.06 beginning October 1, 2025.

Proposed producer responsibility primary regulations
The Solid Waste and Materials Management Program is proposing changes to Sections 1 and 18 of the Regulations Pertaining to Solid Waste Sites and Facilities, 6 CCR 1007-2 Part 1.
The Producer Responsibility Program for Statewide Recycling Act was signed into law in June of 2022. We are required to annually adjust by rule the dollar limitation for realized gross total revenue of producers that are exempt from the requirements of the producer responsibility program under 25-17-7 C.R.S. These adjustments are based on the U.S. bureau of labor statistics local consumer price index. We are also required to establish rules for the administration, operation, and enforcement of the program.

Proposed regulation changes to 6 CCR 1007-2 Part 1: Section 1.2, Section 1.3.2, Section 1.7.6, and Section 10. A review of the changes to the pre-approved Beneficial Use Table 3 for waste tires.
Due to the passage of Senate Bill 24-123, the Waste Tire Program of the Solid Waste and Materials Management Program is proposing changes to the Regulations Pertaining to Solid Waste Sites and Facilities (“6 CCR 1007-2 Part 1”) regulations: Sections 1 (“Administrative Information”), and Section 10 ("Waste Tires"). We will also review changes to the Pre-approved Beneficial Use Table 3 for waste tires.
Two virtual stakeholder meetings will be held with different regulatory topics. Stakeholders are welcome to attend both or either meeting.
Meeting #1 - January 29, 2025: January 29, 2025: Section 1.7.6 (“Waste Tire Fee”), Sections 10.2, 10.3, 10.4, 10.5, 10.6, 10.7, 10.8, and 10.11
Meeting #2 - February 12, 2025: Section 10.13 (“Beneficial Use of Waste Tire Bales”), review of the pre-approved Beneficial Use Table 3 for waste tires, Section 10.12 (“Waste Tire End Users Fund”), Section 10.14 (new) (“Enterprise Board Waste Tire End Users Fund”), Section 1.2 ("Definitions"), Section 1.3.2 ("Scope and Effective Date") and the draft Statement of Basis & Purpose.
