Purpose of Public Notice: To solicit public comment on the proposed Compliance Order on Consent between the Division and Arapahoe County Water and Wastewater Authority (“ACWWA”). This compliance order resolves ACWWA’s violations of Colorado Discharge Permit System Permit Number CO0040681. ACWWA operates a wastewater treatment facility in Arapahoe County. Purpose of Public Notice: To solicit public comment on the March 26, 202, Notice of Violation/Cease and Desist Order/Order for Civil Penalty issued to Elevation Midstream, LLC. This order was issued in response to Elevation Midstream, LLC’s violations of the Colorado Water Quality Control Act and its discharge permit. Elevation Midstream, LLC operated a planned hydrostatic testing project located in Weld County, Colorado.

Purpose of Public Notice: To solicit public comment on the proposed Compliance Order on Consent between the Division and Kiewit Infrastructure Co. This compliance order resolves Kiewit Infrastructure Co.’s alleged violations of the Water Quality Control Act and discharge permit certification, as identified in Notice of Violation Number IO-240826-1, issued on August 26, 2024. Kiewit Infrastructure Co. conducted commissioning, startup, and disinfection activities at a potable water treatment and distribution facility in Jefferson County, Colorado.

Purpose of Public Notice: To solicit public comment on the March 26, 2025 Notice of Violation/Cease and Desist Order/Order for Civil Penalty issued to Riverside Aggregates, LLC. This order was issued in response to Riverside Aggregates, LLC’s violations of the Colorado Water Quality Control Act and its discharge permit. Riverside Aggregates, LLC operates a sand and gravel mine facility located in Bent County, Colorado.

Purpose of Public Notice: To solicit public comment on the proposed Compliance Order on Consent between the Division and Sunrise Mining LLC. This compliance order resolves Sunrise Mining LLC’s alleged violations of the Water Quality Control Act and its implementing permit regulations, as identified in Notice of Violation / Cease and Desist Order, Number IO-200909-1, issued on September 9, 2020. Sunrise Mining LLC owns and operates the May Day Mine in La Plata County, Colorado.

Draft 401 certifications for discharges from federal facilities

Under section 401 of the Clean Water Act a federal agency may not issue a permit or license to conduct any activity that may result in any discharge into federal waters in Colorado unless Colorado issues a Section 401 water quality certification.  These certifications may include additional permit conditions needed to protect Colorado waters.

EPA issues discharge permits for federal facilities in Colorado. Colorado has received EPA draft permits for the following activities and is requesting comment on draft certifications for these activities.
