Overview
On June 2, 2022, HB22-1244: The Public Protections From Toxic Air Contaminants Act was signed into state law. This law creates a new program in the CDPHE Air Pollution Control Division to regulate toxic air contaminants.
Key elements of the law include:
- Creation of an air toxics monitoring program.
- A requirement for certain sources of air pollution to submit annual toxic air contaminant emission reports.
- A requirement for the division to conduct a needs assessment for the administration of an air toxics permitting program.
The law also directs the Air Quality Control Commission to:
- Evaluate gaps in air toxics reporting.
- Consider revisions to an air toxics reporting program.
- Identify priority air toxics.
- For each priority air toxic:
- Establish health-based standards for General Assembly Approval.
- Develop emission control regulations.
