Toxic air contaminants: Gap analysis and reporting

Overview

On June 2, 2022,  Colorado adopted HB22-1244: The Public Protections From Toxic Air Contaminants Act was signed into state law. This law requires the Air Quality Control Commission to, through rulemaking actions:

  1. Receive a report from the division to identify gaps in toxic air contaminant reporting.
  2. Based on this analysis, consider changes to the toxic air contaminant reporting requirements, beginning with calendar year 2025 emissions.

In October 2024, the Air Pollution Control Division submitted a final gap analysis report to the Air Quality Control Commission.

In April 2025, the commission adopted changes to the state’s toxic air contaminant reporting program based on the division’s analysis. The changes increase transparency, streamline reporting, and require more frequent reporting from a larger number of sources. This will enhance the state’s understanding of air pollution and help inform upcoming actions to address air toxics.

The division will continue to work on methods to collect and share toxic air contaminant reporting data with the public, as well as additional guidance materials and resources to help sources estimate and report their emissions. The first reports impacted by the 2025 reporting rule changes will be due in June 2027.
