Update: The Air Pollution Control Division finalized the gap analysis report and submitted it to the Air Quality Control Commission in October 2024. This report is required before the division proposes any changes to toxic air contaminant reporting requirements created under a 2022 state law: The Public Protections from Toxic Air Contaminants Act.
Background
On June 2, 2022, Colorado adopted HB22-1244: The Public Protections From Toxic Air Contaminants Act was signed into state law. This law requires rulemaking actions by the Air Quality Control Commission to:
- Receive a report from the division to identify gaps in toxic air contaminant reporting.
- Based on this analysis, consider changes to the toxic air contaminant reporting requirements, beginning with calendar year 2025 emissions.

Final reports
The division accepted public comments on the draft gap analysis report through July 3, 2024 and submitted a final report to the Air Quality Control Commission.
Air Quality Control Commission rulemaking and informational hearing schedules
Informational hearing: Oct. 16, 2024.
- Topic: The commission will hold an informational hearing about the gap analysis report for toxics air contaminants reporting.
Request for rulemaking: Dec. 19 - 20, 2024.
- Topic: The division will request the commission set a hearing to consider revisions to air toxic reporting requirements, as required by state law.
